Brazil bans national symbols in gambling advertisements

Brazil’s gambling regulator, SPA, has announced new regulations for gambling advertisements with a ban on the usage of national symbols, currency symbols, and banknotes or coins.
Operators can no longer enjoy the unlimited options of marketing. This means that anything that could mislead players into thinking that prizes will be paid in cash is banned, as Brazilian law strictly prohibits receiving prizes in cash.
Failure to comply with these rules could result in hefty fines, suspension of marketing campaigns, or even the loss of authorization for future promotions. Additionally, any prize-based promotions must first be approved by the Ministry of Finance. This news follows the debut of Brazil’s regulated online gambling market on January 1, 2025, with 71 issued licenses back in December 2024.
Regulatory fines
On the financial side, the SPA has also detailed how regulatory fees will be calculated. The monthly supervision fee, which is an essential charge that helps fund the regulator’s operations, will be based on gross gaming revenue (GGR) after deducting player payouts. Operators must pay this fee by the 10th of the following month via Brazil’s digital payment system, PagTesouro, using PIX, a credit card, or a bank slip. Operators must pay a 12% tax on GGR, along with other federal and municipal taxes.
