Brazil’s ban comes from Provisional Measure No. 1,394/2026, which President Luiz Inácio Lula da Silva issued on September 25, 2026, targeting fixed-odds betting, and betting sites and apps were ordered to go offline on October 6.
On October 8, Judge Cristiane Farias Rodrigues dos Santos of São Paulo’s 9th Federal Civil Court allowed Stake to operate until October 25, as long as it froze new promotions and bonuses and guaranteed player withdrawals.
The government appealed, and Judge Luis Antonio Johonsom Di Salvo, president of the Federal Regional Court of the 3rd Region, suspended the injunction. He wrote that one company staying authorized while others faced restrictions prevents the appropriate implementation of the public policy and shows regulatory asymmetry.
Stake’s website now states:
“On October 8, 2026, a decision by the Federal Court authorized Stake Brasil to resume operations. However, this decision was suspended by the Federal Regional Court of the 3rd Region. Therefore, since October 10, 2026, the Stake Brasil website and app have been unavailable again. We are very sorry about this situation.”
Brazil’s Supreme Federal Court is still reviewing the measure, and Stake’s request to keep its license until December 31, 2029 remains unresolved. Until a final judgment or a new ruling, Stake stays offline in the market.
