DraftKings faces $2M lawsuit in gambling addiction case
DraftKings is facing a federal court lawsuit after an Illinois resident accused the operator of ignoring signs of problem gambling and letting him lose more than $2 million.
According to Chicago court filings from June 24, 2026, Dane Miller has claimed that DraftKings enabled his gambling addiction, which led to him losing his job, draining his wedding fund, and developing suicidal thoughts before seeking help. Miller had first opened an account with the operator in 2020, after which he was elevated to a VIP status in May 2021.
The complaint states:
“DraftKings quickly realized the potential in Miller and crowned him as a VIP in May 2021. As a VIP, DraftKings showered Miller with many lucrative ‘perks’ including but not limited to promotions, profit boosts, free bets, DK cash, deposit matches, and tickets to professional sporting events.”
Additionally, Miller took out personal loans, made credit card advances, and withdrew money from his 401k, after which he went on to write a suicide note and was later hospitalized. The lawsuit further reveals that DraftKings sent Miller 5 sportsbook credits worth $200 each during this period, causing him to relapse.
The court filings mention:
“DraftKings relies heavily on behavioral analytics, secret algorithms, and “hyper-personalized retention efforts” to create a highly addictive product. This results in users overestimating their skill and the probability of winning, which leads to increased engagement and a continual loop of chasing losses… a hallmark of the transition from recreational to disordered gambling.”
The defendant lists lost earnings, medical costs, and emotional distress as damages caused by DraftKings, seeking compensatory, exemplary, and punitive damages in return.
