DraftKings files lawsuit against Philadelphia to block probe
On July 16, 2026, DraftKings filed a lawsuit against the city of Philadelphia in an effort to challenge the enforcement of the Consumer Protection Ordinance and block an investigation into the operator.
According to the Philadelphia federal court filings, DraftKings has argued that Philadelphia had no right to enforce the 2024 ordinance, as it went against Pennsylvania’s consumer protection and unfair trade practices laws. The lawsuit comes after the Philadelphia Consumer Protection Ordinance (PCPO) permitted an investigation and issued a subpoena to DraftKings, which additionally authorized the city to penalize the operator for unfair practices.
Under the subpoena, the city has been allowed to request betting revenue, user targeting, promotions, VIP programs, and responsible gambling records. DraftKings additionally shared that on July 9, 2026, Philadelphia confirmed that it would start a civil enforcement action against the company.
A DraftKings spokesperson shared:
“The city has acted beyond the scope of its authority on matters governed by state law and regulated by the Pennsylvania Gaming Control Board. DraftKings remains committed to operating responsibly and in full compliance with Pennsylvania law, and we look forward to addressing this issue through the legal process.”
DraftKings’ further arguments claim that Pennsylvania’s Gaming Act gives exclusive authority over gambling activities to the Gaming Control Board; however, the ordinance is set to remain in place unless a court ruling decides against it.
