The Autorité Nationale des Jeux (ANJ), the French gambling regulator, has directed French online casino operators to examine and modify their terms and conditions in order to eliminate any clauses that may be objectionable.

Customers’ complaints to Mediateur des Jeux en Ligne (Mediateur) over the content, context, and legitimacy of specific provisions triggered the start of this review.

Since its founding in 2019, Mediateur has served as an independent mediator in disputes between French online gamblers and licensed operators, such as PMU (French horseracing) and FDJ (national lottery).

Without imposing standardized contractual duties on licensees, the ANJ seeks to guarantee a sufficient degree of legal compliance among gambling operators. Finding and eliminating any material from the clauses that is illegal, unclear, or potentially damaging is the main goal of the review.

Any content restricting a customer’s right to compensation or unjustly limiting their responsibility has been ordered to be deleted or modified by the operators. Clauses that, for instance, restrict a customer from filing a lawsuit, including those mandating that the player submit complaints to a court other than their home court, are prohibited.

Operators are also not allowed to limit the types of evidence that clients can present or to set a deadline for challending disputes. The clauses that exempted operators from liability, restricted legal actions, limited evidence in disputes, shortened claim periods, allowed unjustified bet limitations, and unfairly reduced payouts in certain outcomes have all been identified and removed by the ANJ and Mediateur as unfairly restricting players’ rights.

In order to solve issues with legal jurisdiction, evidence availability, claim rapidity, and payment equity in the French online gambling sector, stricter oversight of terms and conditions is being implemented. The goal is to guarantee a more equitable and transparent gambling environments.
