Crypto.com’s prediction market platform OG has filed a federal lawsuit against the Attorney General of Washington and the Washington State Gambling Commission (WSGC), asking the court to grant declaratory and injunctive relief.
Filed on July 22, 2026, just 2 days after a Washington court ruled Kalshi’s operations as illegal gambling, OG has asked the U.S. District Court for the Western District of Washington to issue the relief against AG Nick Brown and WSGC members, arguing that there is imminent risk that the state will launch similar enforcement action against its prediction platform.
According to the complaint, OG has stated that it’s regulated by the Commodity Futures Trading Commission (CFTC) and that the federal government has exclusive authority to regulate prediction markets. Under the Commodity Exchange Act, states are blocked from applying their laws on federally regulated products.
The lawsuit states:
“The threat of Defendants’ enforcement of Washington law poses a direct and imminent threat to OG’s business and its users and disrupts the comprehensive federal framework that places OG exclusively under the CFTC’s supervision. A declaratory judgment and injunction are necessary to prevent Defendants’ unlawful intrusion into a market which they have no legal authority to regulate.”
OG further claims that state enforcement directly conflicts with the federal regulatory framework that supervises Designated Contract Markets (DCMs) and may affect the impartial and orderly event trading.
