DraftKings receives another lawsuit from a player
A Texas resident has taken DraftKings to court, accusing the popular online sports betting company of unfairly shutting down user accounts and keeping the remaining balances.
The lawsuit was filed in a Massachusetts federal court on December 23 by Eric Avila. According to him, DraftKings often closes player accounts for violations of its terms of service but refuses to let players withdraw their money, citing the account’s closure as the reason. Avila claims that DraftKings closed his account in September 2024 and left him unable to access roughly $100. When he asked for clarification, customer service reportedly provided no specific explanation, citing “compliance” issues.
Eric Avila said in the lawsuit:
“Hiding behind unspecified ‘compliance’ requirements, DraftKings then denies those individuals the opportunity to withdraw their balances, telling users they cannot withdraw the funds because their accounts are closed. This results in a catch-22 for affected users: Users cannot withdraw funds from their DraftKings account because DraftKings has decided the users do not have a DraftKings account.”
The lawsuit further states that DraftKings frequently shuts down accounts under suspicion of users having multiple accounts, even without evidence and aims to represent all affected players, with the prediction that DraftKings has used millions of dollars. The lawsuit demands restitution of funds, damages, and attorney fees.
