Kalshi gets federal judge backing in Tennessee case
Issued on January 12, 2026, by US District Judge Aleta Trauger, an order has blocked the Tennessee Sports Wagering Council from enforcing state gambling laws against Kalshi.
The court concluded that Kalshi’s claims against the state are likely to be ruled in the operator’s favor, as Tennessee’s enforcement action breaches rights preempted by federal authority.
A preliminary injunction hearing is set for January 26, 2026, where Kalshi is ordered to post a $500 security bond before the temporary order remains in effect.
The main issue of the case is Kalshi’s position as a platform regulated by the Commodity Futures Trading Commission (CFTC), where it has to be determined whether the operator’s sports-related event contracts are classified as gambling under Tennessee law or not.
The current ruling doesn’t resolve the full dispute; however, it keeps the status quo while the court decides if state regulators can manage federally approved event contracts. Meanwhile, state officials stress that Kalshi’s product falls within restricted sports betting activity when offered to Tennessee users.
In response, Kalshi argues that its product is a federally authorized financial instrument, which protects it from state-level gambling enforcement.
Additionally, the Tennessee Sports Wagering Council had ordered Polymarket and Crypto.com to stop offering prediction contracts to state residents as well, citing illegal gambling activity.
