Nebraska adds online betting legalization to November ballot

On August 21, 2026, Nebraska’s Secretary of State shared that 2 petitions seeking to legalize online sports betting have been approved to be presented to the voters during the November general election.

If passed, the first petition, called “Online Sports Wagering Authorization Constitutional Amendment,” would amend the state’s laws to legalize online sports betting, while the second one, called “Online Sports Wagering Regulation Initiative,” would create a new regulatory framework to manage online sports betting in Nebraska.

The approval of the petitions means that they generated at least 138,473 and 96,918 valid signatures, respectively, to meet the requirements.

Sponsor of the petitions, Jordan McGrain, commented:

“We are grateful to every Nebraskan who participated in the process and signed our petitions. We believe voters will agree that a legal and regulated online sports wagering marketplace will keep the money in Nebraska, generating new revenue for local communities and millions of dollars in property tax relief.”

According to the language of the proposals, operators would be allowed to run up to 2 platforms offering online sports betting. Currently, Nebraska doesn’t permit mobile betting, and sports bets are only authorized at pre-approved windows and kiosks that are located in licensed racetrack enclosures.

Additionally, a report commissioned by Tax Relief Nebraska has revealed that legalized online sports betting could potentially generate over $87 million in tax revenue over the coming 5 years.
