On January 16, 2026, Nebraska casino operators filed two ballot initiatives with the Nebraska Secretary of State’s Office in an effort to legalize online sports betting in the state.

The initiatives are supported by WarHorse and the Sports Betting Alliance, a national coalition of sports betting operators.

According to Lynne McNally, director of government relations at WarHorse Casino, the first initiative aims to amend the constitution to allow licensed sports betting. Following that, the second initiative seeks to send tax revenue from online sports betting to the cities where bets are placed.

To qualify for the ballot, signatures from at least 10% of registered voters must be collected for the online sports betting legalization initiative and 7% for the tax revenue initiative.

It was expected that Nebraska casino operators would pursue a ballot initiative after the measure wasn’t advanced in the Legislature’s last session.

McNally stated:

“With the many issues that are coming up during the session with only 60 days, we didn’t feel that we could just rely on that going through to make the ballot this fall. I’ll be putting a lot of miles on my car, and we’ll be letting Nebraskans know what the advantages are of voting for this initiative.”

Additionally, to appear on the ballot, both initiatives will have to be signed by 5% of voters in 38 of Nebraska’s 93 counties.
