New York State Senator Nathalia Fernandez has introduced two bills, SB 10400 and SB 10401, which aim to restrict billboard ads for gambling, sports betting, tobacco, alcohol, and vaping.

The measures are specifically aimed at fighting against the promotion of harmful entertainment and substances and were first submitted on May 15, 2026. Both are now under review by the Committee on Consumer Protection.

Senate Bill 10400 is a more wide-ranging prohibition measure, under which all individuals, advertisers, and corporations would be banned from showing or maintaining billboard ads that promote gambling activity, which includes multiple formats such as casino gaming, sports betting, fantasy sports, lotteries, sweepstakes, as well as bookmaking, betting pools and exchanges, and interactive gaming.

According to the bill, billboard advertisements cover both traditional and digital formats that are visible from public areas like sidewalks, roads, or parks.

Senate Bill 10401, on the other hand, is more gradual, requiring gambling billboard ads to be removed when their advertising contracts expire. After this, the government would have to place warning messages about the harms and risks connected to the advertised product if a new ad doesn’t replace the previous one.

In the case that the measures are passed, both are set to come into effect immediately.
