The Netherlands Gambling Authority (KSA) has recently sent out warnings about advertising campaigns and marketing strategies that should correspond to certain regulations.

The warning comes after a TV spot  where “a commercial for a television channel featuring a football player in a T-shirt with the name of an online gambling provider on it ” was shown.

It is forbidden to advertise online gambling in any way on TV, radio, or in public areas in order to protect young adults and other people at risk from it. Regardless of who promotes their products, KSA reminded licensed operators that they are always in charge of how their brand is expressed.

Non-targeted advertising for online gambling has been prohibited since July 2023. This restriction will apply to TV shows and sponsorships as of July 1, 2024.

Operators that are under the Remote Gambling Act (KOA) are responsible for ensuring that their marketing focuses on at least 95% of adults who are 24 or older. Operators that are licensed by KOA have to engage in self-monitoring, record keeping and submit individual marketing reports to KSA.

The warning concluded that the KSA will only issue a warning rather than a stiffer penalty because the provider has taken steps to avoid the offense from happening again.
