Ecuador’s tax agency, the Servicio de Rentas Internas (SRI), has confirmed the implementation of a 15% value added tax (VAT) on betting, sports prediction markets, and other iGaming services.

The SRI issued Circular No. NAC-DGECCGC26-00000004, which revealed that the services that are explicitly included are online video games, sports betting forecasts, sports event streaming, digital entertainment platforms, and digital betting-related content.

The new regulation has noted that digital services that offer automated platforms with minimal human intervention must pay the standard VAT rate, but the taxation process varies based on the provider’s tax residency. For operators in Ecuador, they must issue receipts, collect VAT from the user, and send all payments to the SRI. For non-resident operators that use payment intermediaries, these intermediaries will withhold 100% of the VAT and send it to the necessary tax authorities, but in the case of operators without intermediaries, the users will be tasked with issuing the tax return and paying the tax.

The government believes that the involvement of intermediaries improves the monitoring process and collection of revenue, as the overall measure is created to set transparent tax rules and close the existing regulatory gaps by establishing a more formal digital sector in the country.
