European Court may completely reshape iGaming rules

The European Court of Justice (ECJ) could completely change iGaming rules across Europe.
It all started back in 2021 when a German player filed a lawsuit against Lottoland, a gambling platform licensed in Malta. He claimed he was able to bet on their site from Germany, even though Lottoland didn’t have a German license.
Now, the big legal question is whether Germany’s old gambling law called the Interstate Treaty on Gambling fits within EU law, especially the rules that support the free movement of services across member states. Both sides have asked the ECJ to check the details, with a legal opinion expected on July 10, 2025.
Another hot topic in all this is Malta’s Bill 55, passed in 2023. It allows Maltese courts to block foreign judgments against gambling companies licensed in Malta. Critics argue it undermines legal cooperation in the EU and protects businesses at the expense of players.
The European Commission is now reviewing that law, too. If the ECJ rules against it, Malta could face a wave of compensation claims from players in other EU countries.
