Evolution rejected in sanctions bid against Black Cube
As the legal case continues, Evolution has been rejected in its bid to have a New Jersey judge order sanctions against Black Cube over alleged non-compliance with discovery.
Evolution was previously ordered to hand over files linked to the Black Cube case, but now argues that Black Cube didn’t properly disclose payments and invoices made with competitor Playtech, which had also commissioned the reports against Evolution. The company also added that the court should continue the deposition of Black Cube’s Director, Dr. Avi Yanus.
Additionally, the court has rejected another bid by Evolution to be protected from Black Cube’s own discovery order.
Evolution claimed:
“The requests call for documents and information containing highly sensitive non-public business information, including customer lists, contracts that contain nondisclosure provisions, detailed financial information, and other proprietary information relating to how Evolution conducts its business. The public disclosure of these documents, including to Evolution’s competitors in the online gaming industry, would harm Evolution.”
Black Cube responded:
“Through its motion, Evolution seeks to ensure that the court of public opinion remains open, but only to Evolution, a place for Evolution to air its grievances, but not for Black Cube or C-K to defend themselves.”
The latest developments follow Black Cube’s successful request to get the court to implement its own protective order, which prohibits its agents from being unmasked as part of the case.
