Poland to criminalize the promotion of online gambling

The Sejm, Poland’s Parliament, is discussing plans to ban “patostreaming,” which is the online broadcast of violence, abuse, and sexually degrading material, and classify online gambling promotion as a criminal offense.

As a result of the legislation, the Penal Code would be amended to add new provisions for digital content that is seen as harmful. The goal of the bill is to make sure that online behavior is treated as seriously as physical criminal acts.

Under the law, influencers who promote gambling could face prison sentences of three months to five years. The same measures would be taken against individuals who post real or staged depictions of crimes online.

This step is part of extensive action taken by the Ministry of Finance, the Financial Supervision Authority, and the police to fight against illegal gambling. This refers to raids against influencers who have promoted offshore casinos on Twitch, YouTube, and Kick.

Poland’s new Civic Coalition (KO) government, formed by an alliance of Citizens Platform (PO), Modern (Nowoczesna), and Polish Initiative (iPL), supports the initiative, stressing that these reforms will improve enforcement powers and protect younger people from encountering violence and illegal content.

The bill is positioned as a youth protection initiative, as concerns are growing for minors being exposed to violent streams and gambling promotions. The amendment would classify in-game purchases with randomly awarded prizes as gambling and restrict under-18s from accessing loot boxes.
