Romanian gambling regulator fails to oversee the market
Romania’s Court of Auditors has raised serious concerns about Romania’s gambling regulator, the National Office for Gambling (ONJN), and its failure to fulfill its duty to monitor online gambling operators since it was established in 2013.
In a report submitted on February 21, the court suggested that it might notify Romania’s criminal prosecution authorities due to the ONJN’s failure to enforce a key legal requirement: remote access to all licensed operators’ systems.
One of the main concerns is the mismatch between taxation rates and actual Return to Player (RTP) levels. The ONJN also failed to investigate the lowering of RTP requirements in Malta in 2021, where many of Romania’s operators are based.
The Court of Auditors reported:
“Since its establishment until now, the National Office for Gambling (ONJN) has never monitored or controlled the activity of remote (online) gambling organizers and has not fulfilled its legal duties, such as analyzing the data stored by the game organizers or verifying the accuracy of their periodic reports. During the mission, external public auditors found numerous irregularities in the office’s activity. An important consequence of these irregularities is the failure to generate state budget revenues at a level corresponding to the collection potential from this area of economic activity.”
The report highlights the impact on state budget revenues, with more than 78 million lei ($16.4 million) in unpaid taxes only for 2022 and 2023 alone.
These findings raise concerns about the financial and regulatory impact of the ONJN’s failure to properly oversee the gambling industry.
